Fama Hair Couture
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A MANDATORY INDIVIDUAL ARBITRATION PROVISION AND A CLASS ACTION AND JURY TRIAL WAIVER (SECTION 17) THAT REQUIRE DISPUTES TO BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN BY JURY TRIAL OR CLASS ACTION. THEY ALSO PROVIDE THAT ALL SALES ARE FINAL AND THAT NO REFUNDS ARE ISSUED. BY ACCESSING THE SITE OR PLACING AN ORDER, YOU AGREE TO THESE TERMS.
These Terms of Service ("Terms") govern your access to and use of the website famahaircouture.com (the "Site") and your purchase of products from Fama Hair Couture LLC ("Fama Hair Couture," "we," "us," or "our"), a limited liability company organized under the laws of the State of New York. By accessing the Site or placing an order, you ("you," the "Customer") agree to these Terms. If you do not agree, do not use the Site or place an order.
1. Products
We sell human hair extensions, wigs, and related hair accessories (the "Products"). Each Product is a hygiene-sensitive personal item.
Because our Products are crafted from human hair, natural variation in color, texture, density, wave pattern, and length is expected and is not a defect. Photographs, swatches, and graphics on the Site are illustrative only and may differ from the Product you receive due to screen settings, lighting, and the natural character of the hair. Such variation does not constitute a basis for return or claim.
Our Quality Guarantee. Every Fama Hair Couture order carries our promise of quality. From the hair we source to the way it's wrapped, each piece is handled with intention, because we want you to feel the difference the moment you open the box. If anything ever falls short of that, we want to know.
2. Sanitary Nature of Our Products and Final Sale
For health, hygiene and sanitary reasons, and high demand of our products, all sales are final. Hair extensions and wigs are intimate products worn directly on the body and in contact with the scalp and hair. Once they leave our facility, they cannot be verified as unworn, uncontaminated, or fit for resale. For this reason, and to protect the health and safety of every customer:
- We do not offer refunds of any kind. No monetary refund will be issued for any order, in whole or in part, except where required by applicable law.
- Resolution, where available, is limited to a store credit, and only where the Product is eligible under Section 3.
- This policy is disclosed to you before purchase, and by placing an order you acknowledge and accept it.
3. Returns and Store Credit
Subject to the final-sale and sanitary conditions above, eligible Products may be returned for store credit only. No cash or card refunds are issued under any circumstances.
Clients may return their piece using a carrier of their choice at their own expense. We strongly recommend using a trackable shipping service with signature confirmation. Fama Hair Couture is not responsible for returns that are lost, delayed, or damaged while in transit. Alternatively, Fama Hair Couture can provide a prepaid return label upon request, in which case the cost of the label will be deducted from the store credit issued.
If the store credit is used to place a replacement order, the shipping cost for the new order will also be deducted from the available store credit, unless the original item is being replaced due to a confirmed manufacturing defect or an error on our part.
Eligibility. A Product qualifies only if, within seven (7) calendar days of delivery, you contact us at info@famahaircouture.com and the Product is returned in its original, resalable, and unaltered condition: unwashed, uncombed, uncut, uncolored, unperfumed, untouched, still bound by its original ties, and in its original packaging resell-able condition as well.
Non-returnable items. For sanitary reasons, the following can never be returned, exchanged, or replaced under any circumstances: lace closures, lace frontals, lace wigs, clearance and sale items, and any Product that has been used, washed, combed, cut, colored, bleached, perfumed, or altered in any way.
Quality concerns. If you believe a Product is defective, contact us at info@famahaircouture.com within seven (7) calendar days of delivery and include clear photos and video taken and dated on the day of delivery, along with a description of the concern. If we confirm the concern is valid, we will provide, at our discretion, a store credit.
Signature scent and worn-product detection. Every Fama Hair Couture Product is finished with our signature custom scent. This allows us to identify whether a Product has been worn. Any Product returned worn, perfumed, washed, or otherwise altered will be refused, will not qualify for store credit, and will be returned to you at your expense.
Prohibited alterations. Using products, perming, coloring, lifting, bleaching, cutting, applying heat, applying perfume or fragrance, or removing hair from the weft voids all eligibility for store credit, or any resolution.
4. Orders and Acceptance
Your order is an offer to purchase. We reserve the right to accept, decline, limit, or cancel any order for any reason, including suspected fraud, pricing or description errors, or unavailability. No contract exists until we confirm acceptance and payment by email. In the event of an obvious pricing error, we may cancel the order even after confirmation and will refund any amount charged for that order to the original payment method at our discretion.
5. Pricing and Payment
All prices are stated in your local currency and are exclusive of shipping, taxes, duties, and customs fees unless stated otherwise. Full payment is due at checkout. You are responsible for all applicable sales tax and, for international orders, all duties, customs charges, and import fees assessed by the destination country.
6. Shipping, Delivery, and Risk of Loss
Processing. Order processing: 7 to 15 business days before shipping, to ensure meticulous attention to every order. (may be reduced to 1–2 business days during certain periods). Orders are not processed on weekends and holidays.
Standard shipping. 5 to 7 business days after shipment.
Express shipping. 1 to 3 business days after shipment.
IMPORTANT - SHIPPING ≠ PROCESSING TIME. All orders require a signature upon delivery. No refunds will be issued for refused or unclaimed packages.
Processing time is the time needed to prepare your order before it is shipped (order verification, quality control, packaging). No order is shipped before this step is completed. Standard processing time: 7–15 business days before shipment, depending on demand (may be reduced to 1–2 business days during certain periods).
Shipping time refers only to the delivery transit time after the order has been prepared and dispatched, according to the shipping method selected at checkout.

We are not responsible for any lost, stolen, delayed, or damaged shipments once a Product has been handed to the carrier. Title and risk of loss pass to you upon our delivery of the Product to the carrier. All orders may require a signature on delivery. We are not responsible for packages marked delivered by the carrier, refused, unclaimed, or sent to an incorrect address provided by you. Claims for items lost, stolen, or damaged in transit must be filed by you directly with the carrier. Delivery dates are estimates only and not guaranteed.
7. Order Changes and Cancellations
To ensure fast fulfillment, we begin processing orders the moment they are placed. Therefore, orders cannot be cancelled once they have been placed. We are unable to modify, cancel, or change the shipping address on an order once it has been submitted. Please review your order carefully before checkout.
8. Health, Allergies, and Assumption of Risk
Our Products are worn on the body. You are responsible for proper application, maintenance, and use, and for consulting a qualified professional where appropriate. We recommend testing for sensitivity before use. To the fullest extent permitted by law, you assume all risk arising from the use, application, removal, or wear of the Products, including any allergic reaction, irritation, or injury, and we are not liable for any condition resulting from use, misuse, improper application, or failure to follow care guidance.
9. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Products and the Site are provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Products will meet your expectations, that color, texture, or appearance will match images on the Site, or that the Site will be uninterrupted or error-free.
10. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Fama Hair Couture or its members, managers, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or loss of goodwill, arising out of or relating to the Site or any Product, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or any Product will not exceed the amount you actually paid for the Product giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you; in those cases, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless Fama Hair Couture and its members, managers, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Products, your violation of these Terms, or your violation of any law or the rights of any third party.
12. Pricing Errors
While we strive to ensure all product information and pricing displayed on our website is accurate, errors may occasionally occur.
If a product is listed at an incorrect price or contains inaccurate information due to a typographical error, technical issue, or other mistake, Fama Hair Couture reserves the right to refuse, cancel, or limit any order placed for that product at any time, including after an order confirmation has been issued or payment has been processed.
If your payment has already been captured and your order is cancelled due to a pricing or listing error, a full refund of the amount paid will be issued to your original method of payment.
13. Intellectual Property
All content on the Site, including text, images, graphics, logos, and the Fama Hair Couture name and marks, is our property or that of our licensors and is protected by law. Any unauthorized reproduction or use is prohibited.
14. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, carrier delays, supply disruptions, labor issues, or governmental action.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Before filing any claim, you agree to first contact us at info@famahaircouture.com to attempt to resolve the matter informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to that jurisdiction.
16. Changes to These Terms
These Terms and Conditions apply as soon as you access this website, create an account, or place an order.
Fama Hair Couture reserves the right to update, modify, suspend, or terminate these Terms and Conditions, or any part of them, at any time without prior notice. Your continued use of the website following any changes constitutes your acceptance of the revised Terms and Conditions.
Any provisions that by their nature should survive termination, including but not limited to those relating to Intellectual Property, Trademarks, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Miscellaneous, shall remain in full force and effect following any termination.
We may update these Terms at any time. The version in effect at the time of your order governs your purchase. Continued use of the Site constitutes acceptance of the current Terms.
17. Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
17.1 Informal resolution first. Before initiating any arbitration, you agree to first contact us at info@famahaircouture.com and give us at least thirty (30) days to resolve the dispute informally. Most concerns can be resolved this way.
17.2 Agreement to arbitrate. If we cannot resolve the dispute informally, you and Fama Hair Couture LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any Product, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, will be resolved exclusively by final and binding individual arbitration, rather than in court, except as set out in Section 17.5. This agreement to arbitrate is governed by the Federal Arbitration Act.
17.3 Arbitration procedure. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted in New York County, New York, or, at your election, by telephone, video, or on the basis of written submissions. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
17.4 Class action and jury trial waiver. You and Fama Hair Couture LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You and Fama Hair Couture LLC waive any right to a jury trial. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class action waiver is found to be unenforceable as to a particular claim, that claim, and only that claim, will be severed and brought in court, while all remaining claims proceed in arbitration.
17.5 Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Nothing in this section prevents either party from seeking injunctive or equitable relief in court to protect its intellectual property rights. Nothing in this section limits any non-waivable statutory right you may have under applicable law.
17.6 Opt-out. You may opt out of this arbitration agreement by sending written notice to info@famahaircouture.com within thirty (30) days of your first order or your first acceptance of these Terms, stating your name and your intent to opt out. Opting out will not affect any other provision of these Terms.
17.7 Survival. This Section 17 survives termination of these Terms and your relationship with Fama Hair Couture LLC.
